Molahop Terms & Conditions (Spain – eSIM)

1. Definitions

  • “Molahop”: the company operating the website and selling eSIM plans.
  • “User” / “Customer”: any person who browses the website, places an order, or uses the service.
  • “eSIM”: a downloadable digital SIM profile that enables mobile connectivity.
  • “Operator” / “Carrier”: the telecommunications provider whose network provides connectivity for the plan.

2. Acceptance

By accessing www.molahop.com and/or purchasing an eSIM plan, you confirm that you have read and accepted these Terms & Conditions, as well as any product-specific conditions displayed on the relevant plan page during checkout.

3. Device Requirements and Compatibility

3.1. Compatible and unlocked device. Before purchasing, you are responsible for ensuring that:

  • your device supports eSIM,
  • your device is carrier-unlocked, and
  • your device is compatible with the network bands/technologies used at the destination.

3.2. Molahop does not guarantee performance on devices that are modified (root/jailbreak), running unofficial firmware, or restricted by manufacturer/carrier policies.

3.3. Lack of compatibility or an unlocked device may prevent activation or proper service operation and will be treated as a cause outside Molahop’s control.

4. Account, Accuracy of Information and Security

4.1. Registration may be required to purchase or manage plans. You agree to provide accurate, complete, and lawful information.
4.2. You are responsible for keeping your login credentials confidential and for all activity carried out under your account.

5. Orders, Pricing and Taxes

5.1. Prices are displayed in EUR and include or exclude applicable taxes as indicated during checkout.
5.2. The final price may include service/handling fees if clearly disclosed before payment.
5.3. Molahop may refuse or cancel an order if there are reasonable indications of fraud, misuse, or obvious pricing errors.

7. Plan Activation and Validity

7.1. Activation date. Where required, you must provide an activation date. If not provided, the service may remain pending until the activation date is submitted.
7.2. Early activation. In certain destinations, due to Operator operational requirements, the line may be activated up to 24 hours before the chosen activation date to ensure service availability.
7.3. Open activation window. If an “open activation” option is offered, you must activate within the timeframe indicated on the product page or, if not stated, within 60 days  from purchase.

8. Service Use and Limitations

8.1. Coverage, speed and service availability depend on the Operator network and external factors (location, congestion, indoor coverage, device compatibility, etc.).
8.2. “Unlimited” plans may be subject to fair use policies and/or Operator limitations.
8.3. Certain plans are restricted to specific regions (e.g., USA-only, Europe-only). Use outside the eligible region may result in no service or limited service.

9. Fair Use, Hotspot/Tethering and Restrictions

9.1. To prevent abuse and protect network integrity, Molahop and/or the Operator may apply measures such as reduced speeds, restrictions on certain uses, or suspension/deactivation in cases of abusive or bad-faith usage.
9.2. Internet sharing (hotspot/tethering). Hotspot functionality is not guaranteed across all devices or plans. If the Operator restricts it, your service may be limited or penalized.

10. Technical Support

10.1. Molahop provides customer support via [chat/email] at hola@molahop.com.
10.2. To troubleshoot issues, you may be asked to provide reasonable information such as plan/eSIM identifiers (e.g., ICCID/eID), screenshots, relevant device settings (including APN where applicable), device model, country, and approximate time of the incident.
10.3. Molahop may request standard troubleshooting steps (restart, airplane mode, manual network selection, eSIM reinstallation, etc.) to identify the root cause.

11. Changes, Cancellations and Refunds

11.1. Activation date changes. Where an activation date is required, requests to change the date must be submitted at least [72] business hours in advance. After that, changes may not be possible.
11.2. Service-failure refunds. If the service cannot be used due to issues attributable to the Operator or the eSIM provisioning, Molahop may issue a full or partial refund, taking into account technical verification, downtime, usage already consumed, and the feasibility of reprovisioning.
11.3. No refund is available where:

  • your device is not eSIM-compatible or not unlocked,
  • the issue originates from your device,
  • you do not contact support during the incident (preventing diagnosis),
  • you use the plan outside its coverage region or against the product limitations,
  • the Operator suspends the line due to abuse, misuse, automation, or breach of these Terms.
    11.4. Refund timing. Approved refunds are issued to the original payment method and may take 15 business days depending on your bank/payment provider.

12. Non-rechargeable Plans and Extensions

12.2. If a plan is non-rechargeable and you require additional days or data, you must purchase an extension or a new plan, if available.

13. Promotions and Price Matching

13.1. Molahop may offer discounts, coupons, or promotions subject to specific conditions.
13.2. If Molahop offers price matching, you must provide valid documentation (invoice/order confirmation) showing truly equivalent plans (coverage region, duration, data, restrictions, taxes/fees). Molahop may reject unverifiable comparisons.

14. Intellectual Property

All website content (texts, trademarks, logos, design, software, images) is owned by Molahop and/or licensors. Commercial reproduction or exploitation is prohibited without express written permission, except for personal, non-commercial use.

15. Data Protection (Privacy)

15.1. Molahop processes personal data in accordance with the GDPR (EU) 2016/679 and applicable Spanish data protection laws.

16. Disclaimer and Limitation of Liability

16.1. Molahop is not responsible for interruptions, degraded performance, or unavailability caused by factors outside its control (coverage, congestion, Operator decisions, device compatibility, etc.).
16.2. Unless mandatory law provides otherwise, Molahop’s maximum liability is limited to the amount paid for the affected plan.

17. Suspension and Restriction of Service

Molahop may restrict or suspend service when there are reasonable indications of fraud, abusive usage, unjustified chargebacks, or breaches that may impact the Operator network or third parties.

18. Third-Party Links

The website may contain links to third-party sites. Molahop does not control and is not responsible for third-party content or policies.

19. Changes to These Terms

Molahop may update these Terms at any time by publishing a new version on the website. The version in force at the time of purchase will apply to that transaction, unless a change is required by mandatory law.

20. Governing Law and Jurisdiction

These Terms are governed by Spanish law. Any dispute will be submitted to the courts and tribunals of Madrid, without prejudice to mandatory consumer jurisdiction rules that may apply.
